About this policy

Pasqal, a French simplified joint-stock company registered with the Evry Trade and Companies Register under number 849 441 522, whose registered office is located at 7 rue Léonard de Vinci, 91300 Massy, France, and its affiliates (collectively, referred to hereinafter as “Pasqal” or “we”, “us”, “our”) publishes and offers to its users (referred to hereinafter as the “User”, the “Users” or “you”, “your” or “yours”) access to Pasqal’s community platform, located at the following address: community.pasqal.com (hereinafter referred to as the “Community Platform” or the “Platform”). Access to and use of the Community Platform includes the processing and storage of personal data collected during the use of the website and any associated services.

Pasqal has created this document to communicate its policy and practices regarding the collection, use and disclosure of the User’s personal data (as defined by the General Data Protection Regulation (Regulation (EU) No.2016/679) through its use of and activities on the Community Platform (hereinafter referred to as the “Policy”). Pasqal takes the respect of privacy and the protection of personal data very seriously, and aims, through this Policy, to provide transparency and clarity regarding its processing.

Pasqal thus collects and processes personal data in compliance with Regulation (EU) No. 2016/679 on the General Data Protection Regulation (hereinafter “GDPR”), which has been in force since May 25, 2018, and the provisions of the French Data Protection Act No. 78-17, dated January 6, 1978, and the French Data Protection Act No. 2018-493 enacted on June 20, 2018.

This Policy applies to all of Pasqal’s registered offices and location, and to all of the Community Platform channels through which Pasqal may receive personal data. In the event of any contradiction between this Policy and national legislation of personal data in the countries where Pasqal’s registered offices are located, national legislation will prevail. However, this Policy must always set the minimum level of personal data protection applicable to Pasqal.

How do we collect your personal data?

In the scope of your usage of the Community Platform, Pasqal may collect and process some of your personal data. This personal data may be collected directly or indirectly from you and through any of the devices you use (such as computer, tablet, smartphone, etc.).

For example, Pasqal collects information about you:

  • When you browse the Community Platform through the site community.pasqal.com including its mobile version;
  • When you send us a contact form through the Community Platform;
  • When you register for conferences or events we organize in France or abroad through the Community Platform;
  • When you sign up for newsletter, group updates, marketing alerts or other such information through the Community Platform;

What personal data do we collect?

The data we collect includes, by way of example:

  • Identification data: your surname, first name, title, your country of residence;
  • Contact information: your e-mail address, telephone number;
  • Professional information: your company, your position;
  • Information that you may not directly enter: IP addresses, http protocol elements, site browsing patterns, cookies.

Pasqal maintains an approach of limiting its collection of personal data to only strictly necessary personal data for the use of the Community Platform. However, if it appears necessary for us to collect or to use any more specific categories of personal data (hereinafter “sensitive data”), we will request your explicit consent to do so.

We take great care to protect the privacy of minors. As a result, Pasqal does not intentionally collect personal data from minors.

How do we use your personal data?

We only use personal data if there is at least one legal basis for such use, as specified below:

  • Compliance with a legal obligation incumbent on Pasqal; To protect Pasqal’s legitimate interests;
  • The performance of a contract entered into or pre-contractual measures taken at the request of the data subject;
  • Consent given by the data subject.

We process your personal data in order to:

  • Respond to your requests for information;
  • Publish your comments on the Community Platform website;
  • Manage your registration requests for conferences and events through the Community Platform;
  • Distribute newsletters, articles, information, group notifications and alerts;
  • Inform you about our products and services that may be of interest to you through the Community Platform;
  • Improve the quality of our services and our Community Platform;
  • Distribute B2B commercial offers.

Who will receive your personal data?

Your personal data that we collect is intended for the purposes of using and offering a tailored experience on the Community Platform. In the scope of such purpose, it may also be transmitted to third parties, such as service provides to whom we entrust the performance of certain of our activities on the Community Platforms.

These activities and service providers are:

  • Slack, for the communication tools to answer questions on Pasqal’s technology;
  • Salesforce, to track Users’ journey to better tailor Users’ experience on the Community Platform;
  • Livestorm, to organize online events to animate the Community Platform and to inform Users about Pasqal’s products and news;
  • Auth0, to protect data on our Community Platform and to create a single sign on to access the Community Platform.

Pasqal may be requested by the official authorities to transmit Users’ personal data.

Pasqal ensures that it has sufficient guarantees (including from its partners and service providers) in terms of personal data protection for each data transfer.

If, during browsing, Pasqal provides a link to a third party site through its Community Platform, the rules and policies applicable to that site will apply.

Under no circumstances will Pasqal be held responsible for the processing of your personal data to or by a third party site.

Where is your personal data stored and processed?

As data protection legislation is not equivalent in all countries, Pasqal has chosen to host and process personal data in France or, where applicable, in a European Union country, or to contract with companies that comply with the European Commission’s Standard Contractual Clauses.

Community Platform Users’ personal data may be transferred to Pasqal’s affiliates and, if necessary, internationally, in compliance with the Police and GDPR.

How long is your personal data stored?

Your personal data is stored in accordance with a set of rules. Pasqal only processes personal data that is adequate, relevant and limited to what is strictly necessary for the purposes for which it is processed. In particular, this means ensuring that any personal data’s duration for storage is kept to a strict minimum. This retention period is variable and depends on the nature of the personal data, its purpose and the legal and regulatory aspects to which it is subject.

For Community Platform Users, account information (login details, email addresses, information data etc.) is retained for as long as the services of the Community Platform are provided to such User and will be deleted after 2 years of inactivity by the User on the Community Platform.

How is your personal data protected?

Pasqal ensures that any personal data collection and processing through the Community Platform is carried out with the highest level of security. Pasqal guarantees the implementation of “appropriate technical and organizational measures”, taken according to the nature of the data, the purposes of the processing and any associated risks. In the event of an incident leading to a breach of personal data, Pasqal will notify the incident to the competent supervisory authority and, if necessary, inform the persons concerned as soon as possible.

What are your rights as a Community Platform data subject?

In accordance with the applicable data protection regulations, you have the following rights:

  • A right of access and communication concerning the information concerning you and the associated processing;
  • A right of rectification with the possibility of completing and updating your personal information;
  • A right to portability, in order to transmit the information concerning the person making the request to a third party when this is technically possible, it being specified that this right is only applicable to data supplied directly by the person;
  • The right to determine the fate of your data in the event of your death;
  • The right to erasure of your data;
  • The right to limit the processing of your data;
  • The right to object to the processing of your data;
  • The right to withdraw consent for the use of your data.

Please note that when required by law, in the case of compliance with its contractual obligations, public interest or legitimate interest, Pasqal exceptionally reserves the right not to honor certain contents of requests (related to a request for deletion, limitation and opposition).

Furthermore, in the case of manifestly unfounded or excessive requests, in particular because of their repetitive nature, Pasqal may either:

  • Require payment of a reasonable fee which takes account of the administrative costs incurred in providing the information, making the communications or taking the action requested;
  • Refuse to comply with such requests.

It is, however, Pasqal’s responsibility to demonstrate that such requests are manifestly unfounded or excessive.

How can you exercise your rights?

You may exercise your rights by enclosing a copy of a proof of identity with your request, either:

  • By post, addressed to Mr. Raphaël FAUVEAU, DPO, at the following address: 7 rue Léonard de Vinci, 91300 Massy, France;
  • By e-mail: compliance@pasqal.com.

Pasqal has one month to reply. In the event of a complex request or a large number of requests, this period may be extended to three months. Pasqal will inform you if this is the case.

With regard to any marketing communications relating to the Community Platform, you may withdraw your consent at any time by sending an e-mail to compliance@pasqal.com. Your request will be processed as soon as possible.

How do I file a claim?

If, despite all the case Pasqal takes in processing your personal data, you find that Pasqal does not satisfy your request, you may submit a complaint to the CNIL (Commission Nationale de l’Informatique et des Libertés): www.cnil.fr; 3 Place de Fontenoy — TSA 80715 — 75334 PARIS CEDEX 07.

The Community Platform uses cookies. Cookies enable us to personalize content and advertisements, provide social media and network functionalities, and analyze site activity. We also share information about the use of our Community Platform with our social networking, advertising and analytics partners, who may combine this with other information you have provided to them or that they have collected through your use of their services, including directly or indirectly through your use of the Community Platform.
